  • The Interactive Media Entertainment and Gaming Association (iMEGA) has filed a write of mandamus in Kentucky, looking for the State Court of Appeals to overturn the online gambling domain name forfeiture decision from a couple weeks ago. Earlier this month, Governor Steve Beshear moved to seize the 141 internet gambling domain names in an admitted effort to protect Kentucky’s brick and mortar gambling industry, including horse racing. Judge Thomas Wingate struck down an effort by multiple groups, including iMEGA, to dismiss the motion. Rather than waiting for the December 3 forfeiture hearing to state its case, iMEGA is taking its fight directly to the Court of Appeals. The organization contends that the basis for the seizure, that the domain names are “gambling devices,” does not apply, because domain names are not property. Additionally, since the domain names are not registered in the state, iMEGA claims that they are off-limits.  One more piece of ammunition that Ed Leyden, President of iMEGA, is using is the state’s violation of the Commerce Clause of the United States Constitution. The Commerce Clause gives Congress the power to regulate commerce with other nations, but Leyden claims that in this case, Kentucky is usurping that power.

  • Barry Greenstein’s good works have once again become visible, as a gymnasium has been opened using money the professional poker player donated to Children, Incorporated. The Barry Greenstein Gymnasium was opened on October 16 on the Rosebud Sioux Reservation in Todd County, South Dakota. It is part of the Rosebud Dormitory school on the reservation. Before the organization’s involvement, the dorm was comprised of only four sleeping rooms and dining hall. It is now home to 140 students. Greenstein is known as the “Robin Hood of Poker,” as he donates his tournament winnings to charity. Children, Incorporated’s vision is to “…to continue assisting and cooperating with other organizations and institutions throughout the world which are dedicated to the maintenance, support, education and welfare of needy children, and the maintenance and education of young adults seeking higher education, enabling them to become responsible citizens of the global community.” The organization is the primary beneficiary of Greenstein’s tournament successes, and has received over $1.5 million from him, according to Greenstein’s website. Barry Greenstein earns his “take home pay” through cash games. Greenstein joined Team PokerStars in 2006 in an effort to defray the cost of his tournament entries, as the poker site now pays his buy-ins. This way, he can contribute more to charity.
